These Terms of Service ("Terms") govern your use of the online store operated by Sarah J Mercantile, LLC, trading as SJM Magnetics Co. (the "Site"), and any purchase you make through it. By browsing the Site or placing an order you agree to these Terms.

You must be at least 18 years old, or the age of majority in your state of residence, to place an order.

Custom & Personalized Products

Items on the Site are made to order from photos and personalization text you supply. Because each piece is produced individually:

  • Small variations in print colour, alignment, cropping, sheen, or finish are inherent to custom production and are not defects.
  • Once production has started, an order can no longer be changed or cancelled.
  • Personalized items are final sale, subject to the remake and damage terms in our Returns & Refunds policy.

Your Photos & Text (User Content)

When you upload photos or submit personalization text ("User Content"), you confirm that:

  • You own the User Content or hold all rights, licences, and permissions needed to let us use it to produce your order.
  • The User Content does not infringe anyone’s copyright, trademark, right of publicity, or right of privacy — including characters, logos, and images owned by entertainment, media, or sports organisations.
  • The User Content is not obscene, defamatory, hateful, harassing, or otherwise unlawful.

You keep ownership of your User Content. You grant us a limited licence to store, reproduce, and print it solely to fulfil your order. We may refuse to produce any order whose User Content we reasonably believe breaches these Terms or the law, and we will refund you in full if we do.

Indemnification

You agree to defend, indemnify, and hold harmless Sarah J Mercantile, LLC and its owners, employees, contractors, and agents against any claim, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising from: (a) your User Content; (b) any claim that your User Content infringes a copyright, trademark, right of publicity, right of privacy, or other right; (c) your breach of these Terms; or (d) your breach of any law or third-party right.

Orders & Acceptance

Your order is an offer to buy. We may accept, decline, or limit any order at our discretion — for example in the case of a pricing error, suspected fraud, or a materials shortage. A binding contract is formed only when we send you the order-confirmation email.

Pricing & Payment

All prices are shown in USD (U.S. Dollars). Payment methods accepted are displayed at checkout and processed securely through Shopify. Georgia sales and use tax is calculated and shown before you pay, where it applies. Shipping is charged at a flat rate, also shown at checkout.

Shipping, Local Pickup & Delivery

Delivery is governed by our Shipping Policy. We ship within the United States only, and offer free local pickup from our Jefferson, Georgia address. Carrier delivery estimates are not guaranteed, especially for made-to-order products that include a production window.

Site Content & Intellectual Property

All content on the Site other than User Content — including our logo, product photography, designs, and text — belongs to or is licensed by Sarah J Mercantile, LLC and is protected by U.S. and international intellectual-property law. You may not copy, modify, distribute, or publicly display it without our written permission.

Shopify Platform

The Site is hosted on the Shopify platform, provided by Shopify Inc., which supplies the e-commerce technology that lets us sell to you. Your use of the Site is also subject to any applicable Shopify terms; nothing here makes Sarah J Mercantile, LLC responsible for the platform itself.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, Sarah J Mercantile, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit or revenue, arising from your use of the Site or our products. Our total liability will not exceed the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.

Privacy

Your use of the Site is also governed by our Privacy Policy, which forms part of these Terms.

Prohibited Uses

You agree not to use the Site to: (a) break any law or regulation; (b) infringe anyone’s rights; (c) interfere with the operation or security of the Site; (d) attempt to access non-public areas or systems; or (e) place fraudulent orders or submit false personalization details.

Governing Law & Disputes

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict-of-law rules. Any dispute will be heard by the state or federal courts located in Georgia, unless a mandatory consumer-protection law of your home state provides otherwise.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date, and continued use of the Site after that means you accept them.
